Emu Bush provides native landscaping, bush regeneration, environmental consulting, weed management, and habitat restoration services in Western Australia. The scope, fees, and timelines for any engagement will be set out in a written proposal or service agreement.

Fees will be specified in your service agreement or quote. Unless otherwise agreed:
You agree to provide safe and reasonable access to the project site. You must disclose any known hazards, contamination, underground services, or access restrictions prior to commencement of works.
We warrant that plants supplied will be healthy and true to species at the time of delivery. We do not guarantee plant survival where failure is attributable to factors outside our control (e.g. drought, vandalism, client neglect of aftercare instructions).
Nothing in these Terms excludes, restricts, or modifies any right or remedy under the Australian Consumer Law (ACL) that cannot be lawfully excluded or limited.
To the extent permitted by law, our liability for a breach of a non-excludable consumer guarantee is limited to the resupply of the services or payment of the cost of resupply.
Subject to clause 7, to the fullest extent permitted by law, our total aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.
All intellectual property in our designs, reports, plans, and website content remains owned by Emu Bush unless expressly assigned in writing. You receive a licence to use deliverables for the agreed purpose only.
The parties agree to first attempt resolution through good-faith negotiation. If unresolved, disputes may be submitted to mediation and, failing that, the courts of Western Australia.
